Capital Mitigation
Mitigation includes any of the myriad of events or experiences that constitute the lives of our clients, composing what has been called the “diverse frailties of humankind.” It is the obligation and mandate of the defense team to uncover through comprehensive investigation and ongoing clinical interviewing any and all possible mitigating factors. It is imperative to understand that we are often representing socially, emotionally and psychologically vulnerable clients. As mitigation specialists, we are part of the core defense team and act as zealous advocates on our clients’ behalf with the ultimate goal of saving their life. We work closely and collaboratively with attorneys in a team approach to provide comprehensive and holistic defense to our clients and their families.
The mitigation investigation is conducted through extensive interviews of the client, their family, and other significant persons. We also gather and review any and all available records so that we may prepare and present this information in a coherent and concise manner in order to tell our clients’ unique life history. We act as liaisons with any and all experts upon whom the defense may carefully choose to rely. A primary goal of our efforts is to establish trust with the defendant and their family and take careful consideration of all factors present that are part of their historical biography in order to effectively convey this information.
